En San Juan, Puerto Rico a 31 de octubre de 2002.
Nos pide el peticionario, M & R Developers, S.E. (en lo sucesivo, M & R), revoquemos la determinación del Tribunal de Primera Instancia, Sala de San Juan, dictada el 5 de marzo de 2001. Mediante dicho dictamen, el hermano foro declaró con lugar una solicitud de sentencia sumaria parcial presentada por los recurridos.
Interpuesto el recurso, todas las partes han comparecido. Examinados los argumentos de las partes, expedimos el auto, revocamos la sentencia recurrida y devolvemos el caso al foro sentenciador para la continuación de los procedimientos según lo intimado.

Mediante la Escritura Pública Número 9 de 16 de junio de 1962 otorgada ante el Notario Jaime Pieras, Jr., el Condominio Parking and Miscellaneous Condominium, ubicados en la esquina noroeste de la intersección que forman la Ave. Todd y la calle Carmen en el término municipal de San Juan, fue sometido al Régimen de Propiedad Horizontal. Como parte de la inscripción registral, se acompañó el Plano Gage and Martinson, el cual delimitaba y distribuía los espacios individuales de quinientos ochenta y cinco (585) estacionamientos del inmueble.1
El 1 de noviembre de 1962, mediante la Escritura Pública Núm. 39 otorgada ante el Notario Angel M. Martín, se modificaron los espacios del estacionamiento del Condominio. En lo pertinente, señala la Escritura que:

The above described Parking Garage contains five hundred eighty five (585) spaces, each measuring eight feet six inches (8´6) wide by eighteen (18´) feet long, divided substantially in accordance with the plans prepared by the firm of engineers named Gage and Martinson, of three hundred five East sixty third Street, New York, New York, Job Number one hundred seventy eight (178), a copy of which plans are annexed to the original and first certified copy of the aforesaid Deed number nine entitled Deed Construction and Constitution of Property in Co-Ownership.
Las anteriores escrituras fueron presentadas conjuntamente en el Registro de la Propiedad.
El 6 de mayo de 1964, mediante la Escritura Núm. 24 otorgada ante el Notario Angel Martín se modificó, nuevamente, la escritura matriz. Dicha escritura, intitulada The Modification of Deed of Construction and Constitution of Property in Co-Ownership, Individualization of Property in Co-Ownership, en lo pertinente, dispuso que:
the plans of Gage and Martinson were designed for the purpose of the division of the various parking levels into parking spaces. Therefore, for the purpose of the individualization of the parking spaces, and for no other, the graphic description of the spaces as they appear on the plans of Gage and Martinson shall prevail.
El 18 de enero de 1965, mediante la Escritura Núm. 3, intitulada Deed of Individualization and Sale of Properties in Co-Ownership, otorgada ante el Notario Angel M. Martín, Castle Enterprises, Inc. (en lo sucesivo, Castle), adquirió ocho (8) estacionamientos. Dos años más tarde, el 10 de enero de 1967, mediante la Escritura Núm. 4 otorgada ante el mismo Notario, City Enterprises, Inc. (en adelante, City), adquirió 20 espacios de estacionamiento.
