EXECUTIVE ORDER OF THE GOVERNOR OF PUERTO RICO, HON. WANDA
VÁZQUEZ-GARCED, TO MAKE A TECHNICAL AMENDMENT TO ADMINISTRATIVE
BULLETIN NO. OE-2020-62.
WHEREAS:
On August 14, 2020, Act No. 107-2020, known as the “Puerto Rico
Municipal Code,” was enacted, repealing Act No. 81-1991, as
amended, known as the “Puerto Rico Autonomous Municipalities Act.”
WHEREAS:
Administrative Bulletin OE-2020-062 (“OE-2020-062”) shall enter into
force on August 22, 2020.
WHEREAS:
As part of the plan to monitor compliance with the restrictive measures
imposed to control the spread of COVID-19 in Puerto Rico, OE-2020-
062 authorizes the enactment of collaborative oversight agreements
between municipal governments and relevant governmental
organizations, pursuant to the Puerto Rico Autonomous Municipalities
Act.
WHEREAS:
The Puerto Rico Municipal Code lacks a transition clause; therefore, it
came into force immediately after its passing.
THEREFORE:
I, WANDA VÁZQUEZ-GARCED, Governor of Puerto Rico, by virtue of
the powers inherent to my office and the authority vested in me by the
Constitution and the Laws of the Government of Puerto Rico, hereby
DECLARE and ORDER the following:
Section 1:
The Twenty-Seventh section of OE-2020-062 is hereby amended to
read as follows:
Section 27 INTERAGENCY OVERSIGHT GROUP. In order to
monitor compliance with this executive order, all relevant entities,
including, without limitation, the Department of Public Safety and all its
components, which includes the Puerto Rico Police Department, the
Special Investigations Bureau, and the Puerto Rico Firefighters Corps,
in addition to the Puerto Rico Department of Consumer Affairs (DACO,
for its Spanish acronym), the Department of Treasury, Department of
Health, the Department of the Family, the Department of Natural and
Environmental Resources (DNER), the Puerto Rico Permits
Management Office, and the Office of the Commissioner of Financial
Institutions, are hereby authorized to set up their monitoring plans in
coordination with PROSHA, for the purposes of issuing appropriate
fines and sanctions under their jurisdiction in accordance with all
applicable legal provisions. This includes, without limitation, the closure
of businesses due to noncompliance with this Executive Order.
Similarly, these governmental organizations shall be able to enter into
collaborative oversight agreements with municipal governments, which
may take similar action within their respective jurisdictions in
