El recurrente Santiago Villanueva Hernández
nos solicita que revisemos y revoquemos una resolución de la Oficina del Comisionado de Instituciones Financieras (OCIF) emitida el 17 del mayo de 2007 y notificada el 18 de mayo siguiente. Mediante dicha resolución, la OCIF -al denegar una solicitud de reconsideración-
se reiteró en una determinación previa en la que desestimó la querella presentada por el recurrente.
Oportunamente la OCIF presentó su alegato en oposición a la revisión solicitada por el recurrente. Perfeccionado el recurso con la comparecencia de ambas partes, resolvemos.
El 3 de agosto de 2006 el recurrente presentó ante la OCIF una querella contra Oriental Bank & Trust
(Oriental). Alegó en la querella, que el 31 de marzo de 2001 había adquirido u originado un Certificado de Depósito del tipo INDEXED CD por la suma de $3,000, por un término de cinco años. Planteó que al vencimiento de dicho término, el 31 de marzo de 2006, Oriental le había liquidado menos del principal del certificado y cero rendimiento de intereses, entregándole la suma de $2,700 y reteniendo el 10% ó $300 para el pago de contribuciones. Solicitó que se determinara si Oriental había computado correctamente el rendimiento del certificado.
Con posterioridad a la querella e iniciado el procedimiento administrativo ante la OCIF, Oriental presentó su contestación a la misma.
Recibida las alegaciones de las partes y la evidencia sometida por éstas, el 17 de abril de 2007 la OCIF dictó resolución, con determinaciones de hechos y conclusiones de derecho, decretando la desestimación de la querella. Dicha decisión fue fundamentada en los siguientes términos:
En los documentos provistos al Querellante por el Querellado con relación a la apertura del Indexed CD, se incluye lo siguiente:
Minimum Deposit and Term. The required minimum deposit for a stock market
indexed CD account (the Indexed CD) is $10,000. The term of the
Indexed CD is five years from
the date of the opening. Indexed CDs will
only be issued on the last
business day of the month.
Oriental Bank
& Trust will compute the interest on
the Indexed CD as follows:
The
S&P Index value on the day the
Indexed CD is opened is established
as the Initial S&P 500 Index value. Thereafter, Oriental Bank & Trust the S&P 500 Index value as of the last
business day of each month
during the term of the
Indexed CD (month-end
S&P 500 Index value). On
the Maturity Date, Oriental Bank & Trust computes the average of
the month-end S&P 500 Index value over the term by
adding together the month-end S&P 500 Index value (not including
the initial S&P 500 Index Value) an then dividing that
total by 60 to determine the average S&P Index Value. Oriental Bank & Trust then computes the average percentage
increase in the S&P 500 Index, if any, by taking the
average S&P 500 Index value
and subtracting from it the
initial S&P 500 Index value. The Indexed CD will earn interest
equal to 125% of the average
percentage increase in the S&P 500 Index.
The Indexed CD pays simple interest only. Since the interest
computation and crediting occurs only at maturity, there is no compounding of interest. If the average of
the month-end S&P 500 Index value is less than or
equal to the Initial S&P 500 Index value (i.e., the
average percentage increase in the S&P 500 Index over the term is 0% or
lees) the Indexed CD will pay no interest.

El Indexed CD tuvo un período interino, antes de ser invertido en el fondo, de seis (6) días (del 26 de marzo de 2001 al 30 de marzo de 2001), por lo que el pago por concepto de intereses durante dicho período era de $2.30 (3,000.00 x .05/365 días) x 5 días).
Con relación a la solicitud por parte del Querellante, de que se investigara si el Indexed CD había generado intereses durante los cinco (5) años de su vigencia, la Oficina determina que no procede el pago de intereses por concepto de la inversión del Indexed CD. La determinación de la Oficina se basa en la siguiente información:
